Deck Permit Requirements in Austin, TX

Do you need a permit?

Usually yes. Austin only exempts a deck that is 200 square feet or less, no more than 30 inches above grade at any point, not attached to the house, does not provide an exit from the house, and is not in a flood hazard area. Attached decks and larger or higher decks need a permit.

What to know

  • Uncovered wooden decks are applied for through the city's residential pool/deck permit service.
  • Non-structural repairs limited to existing deck boards (not guardrails or handrails) are exempt.
  • Zoning setbacks and impervious cover limits still apply.
  • Electrical work on the deck needs its own permit.

  • Site plan showing the deck, property lines, setbacks and easements
  • Construction drawings showing size, height, framing, footings, guards and attachment

Who can apply & how

  • Residential permits are reviewed by Austin Development Services for compliance with the Land Development Code (Chapter 25-2), the 2024 International Residential Code, and local amendments (Chapter 25-12).
  • Applications are submitted online through the city's Residential Plan Review service pages; the city's “Do I Need A Permit?” tool can help you check your project.
  • Exempt work must still comply with building codes, city codes and other ordinances. Nearly every exemption is lost if the property is in a flood hazard area.

Practical tips

  • Check the city's FloodPro map — being in a floodplain removes the exemption.
  • Check HOA deed restrictions before you design.
